5-02-11


The Winchester Planning Board will be meeting at 7:00pm on 5-02-11 on the Main Floor of the Town Hall for the following public hearings:

1. The board will hold a hearing on the suggested changes to the Site Plan Review Regulations and checklist.
2. The board will hold a hearing on the suggested changes to the Rules of Procedure.

Copies of the proposals are available for review at the Town Hall during regular business hours.

News out of town hall... Mary Ryan lawsuit dismissed by Superior Court Judge. Appeal filed too late.

Another victory for the town perhaps? At least we don't have to pay for any more legal fees to defend these ridiculous claims.

If this is true, how come Winchester Informer has not changed its headlines that the town was sued?
Perhaps not news informer does not want people to know about? Is it true informer?

Idiots don't realize that this is just the beginning and that an appeal to the Supreme Court would be filed. And then the process will start all over again when they give him a final approval, we're not going away or stopping our efforts in this fight. Rules are for everyone and must be followed accordingly, when they are not, lawsuits result. If the Winchester planning board did nothing wrong then why are they now suddenly making changes to their site plan regulations and removing all the language in regards to reconsideration. Sounds to me like they are making a last ditch effort to cover their asses to avoid more suits. Too late they screwed up and no it and it wasn't accidental. This time they have been caught lying red handed and will pay.

"not giving up" where did you get your information? Has the lawsuit been ended? Who can file an appeal to the Supreme Court? What will this do?

Any decision by a lower court, in this case the Superior Court, can be automatically appealed to a higher court, which in this case would be the New Hampshire Supreme Court.
If an appeal is filed than an injunction would be in place halting any action on the asphalt plant. It would be foolish and expensive for Mitchell to continue knowing that he could well lose if the Court overturns the lower court's decision.
This would also be very expensive for the town as well in regards to lawyers fees, depositions, certified records etc, etc. to defend the actions of the planning board.
It would seem that Sharra and her cohorts on the board are circling the wagons anticipating more court action and are attempting to rewrite more regulations before the next court action.
If this group were above board and had correctly followed their own rules and regulations during these procedures would any of this attempt to change and remove certain parts of the Rules of Procedure be taking place now?

I have just read the last entry from "This is for you Mike" and don't know who the "she" is that is being referred to, and am extremely concerned about the degree of anger and hate being voiced in this forum. How does any of this help Winchester or any of the issues?

Don't get your panties in a bind over someone's feelings for Ms. Sharra, the post has been removed for language; however we do agree that Ms. Sharra leaves a lot to be desired in her dealings with the public and other members of the board.

How come you don't get just as upset with her when she breaks the law and costs all of us thousands of dollars and lies to your face while she smiles at you? Kinda one sided aren't you? Here is another sad fact with the historical commission, I have read all the rules and regulations that they can enforce on us home owners like what color we paint with stopping us from putting in modern windows to conserve on our heating bills etc. etc. but no where in the rules does it state that you cant tear down your building and build something new. I think that in some cases this may be easier and more cost effective for some of us than abiding by this groups rules. time for this group to go away.
