Mitchell in Violation

For those of you who have not noticed, the asphalt plant on the site of the old P&H gravel pit has been making asphalt and selling it commercially since August 26th in violation of town ordinances and regulations and with no final approval from the Planning Board, or the State of New Hampshire.  Numerous complaints have flooded the Winchester Code Enforcements Office and the BOS with no results. Leroy Austin refuses to act and issue a cease and desist even though he knows Mitchell has not had a stack test done by the DES and won't for another 2-3 weeks if they schedule it by then or a compliance hearing by the Planning Board and his selling of asphalt is illegal. I guess we pay him to sit on his ass and do nothing. His failure to act is a disgrace and a slap in the face to all of the taxpayers who are now deeply affected by smoke, fuel oil fumes and hazardous emissions wafting over the area as far north as Ryme's Fuel and south beyond the Speedway. Many  residents of Winchester and Swanzey  and especially residents of Westport Village weren't able to enjoy their yards this past holiday weekend as fumes and smoke from the plant hung low in the air over the area all weekend. Throw in the noise from the constant beeping from trucks and equipment backing up, tailgates slamming and the rock crusher running constantly all day long it has become a real nuisance. It should not be like this, there are regulations that can be enforced; but when you have people who ignore their constituents and turn their heads and make backroom deals, you have serious problems.  We have been told through the rumor mill that the Town has entered into a contract with Mitchell to purchase asphalt for the sewer and water plant renovations and another rumor circulating is that the recently paved class 6 road in town running to property acquired by the Conservation Commission was done with asphalt made at this plant. Seems an inside deal has been reached between the town and Mitchell before he even has his hearing. For those of you who say who cares, we can think of better ways to spend your tax dollars instead of lining Barton Mayer's pockets when the lawsuits start getting filed. There are laws against subjecting neighbors to constant noise, dust and smoke and fumes from this plant, it's too bad that the Town would rather spend money defending their non-actions than honoring the oaths they took to protect the Town and it's citizens from harm.

For those of you who don't care one way or the other, perhaps the next polluter will be in your back yards ruining your property, health and lifestyle, then we'll see how much you care.

We all know Leroy isn't worth the money he gets paid. He's a phony and only does what he's told and will tell you how hard he's working to keep the town up to code when all he does is sit and socialize all day long. That he has allowed this business to operate illegally for all this time shows us all we had better start paying attention as to what goes on in other parts of town before we end up with a mess like this in our own neighborhoods. I feel sorry for what is going on out in the far end of town and hope people close to that plant get some relief from the courts. It is obvious that the select board and planning board have already made up their minds as to approve whatever business they feel like over their moral obligations to protect us from this exact kind of thing.

I am an abutter to this plant, though I was never officially notified when Mitchell submitted his application to the town as is required by law; but this has happened before with another applicant who wanted to build condos on the hillside behind my home, I wasn't considered an abutter then either. This proposed plant is just a few hundred yards from my property and my house, across the highway and river and I am one of many who have filed complaints with the State and the Town in regards to noise, smoke and chemical pollution from this operation. Mitchell has openly lied to the State telling them they are "only" getting the plant ready for inspection and doing a little paving on the property according to an agreement with the town, when in fact for the past two weeks they have been openly operating and making and selling asphalt despite not having had a final inspection from the State or a compliance hearing before the Planning Board. This plant spews smoke, gaseous fumes and hazardous emissions every time it is fired up. The air is filled with the smells of fuel oil, propane and other odors that are irritating to your eyes and breathing. My wife who suffers from chronic obstructive pulmonary disease; otherwise known as COPD can not go out into our yard and we must close all of our windows when this plant is in operation. The fumes and smells make her so sick she vomits and has had to use her inhalers constantly in order to breath. Last weekend was so bad she actually had to leave our home and stay with relatives out of town. This is not acceptable, that someone is driven from their home by a business is unlawful and just plain wrong.
I have met with Leroy Austin, given him photos of the pollution coming from this plant and filed a written complaint. And though he tells me he knows what's going on and fully agrees with me that this is illegal, he says his hands are tied and there is nothing he can do. I don't believe him for one minute, he is after all our Code Enforcement Officer and Mitchell is breaking the law by making and selling asphalt without final approvals. If his hands are tied as he states, then who is preventing him from acting? The laws and regulations are on the books, it's in his capacity as our Town Code Enforcement Officer to enforce those laws and regulations, so why isn't he?

Since Mitchell purchased this property and started preparations to bring this plant to town, people in this area have been subjected to a constant noise level that is unacceptable, from early morning to late evenings sometimes seven days a week. The sound of his rock crushing operation and the dust it raises have been well documented and yet Leroy and the Town refuse to enforce current ordinances and laws regulating this nuisance.
These people we have in office are suppose to act in a lawful manner to protect the citizens of Winchester from just this kind of abuse; yet our town officials turn a deaf ear and a blind eye to this situation inviting more litigation and more expense when this all could be resolved by just enforcing current rules and regulations. Why, why are they refusing to act in a lawful manner? This makes one wonder what's in it for the few elected officials we have in this town?

For those of you who would tell me to pack up and move or shut up and let free enterprise do as it will, to hell with you. This is my home, I am a taxpaying resident of this town just like the rest of you and my taxes have always been paid on time, every year, no exceptions. I expect to be treated as such. I expect to be afforded the same considerations as everyone else who lives in Winchester and I will not to quietly into the night as some of you would love. If our town officials will not protect me and my wife and the residents in this area from harm and this injustice, then we will consider them part of the problem and include them in our lawsuits against this plant. There are laws governing nuisances as well as polluters and we will use the law to bring us relief and protection that we should get from our elected officials but are not.

This battle will cost Mitchell and the Town of Winchester and myself as a taxpayer thousands upon thousands of dollars, all because our elected officials have refused to protect it's citizens and have openly acted in favor of this plant from the beginning for reasons only they know.

I just drove by and could see the smoke and smell a strong smell of something that wasn't like road tar it smelled more like some chemical cooking. You can also see the haze hanging over that whole area starting when you come down the hill by the mini mart and I could see it in my rear view mirror as I passed the speedway. No wonder those people around there are complaining, I would be to.

This is so wrong, another black eye for our town. Why do we continue to allow things like this to go on in Winchester? This why this Mitchell came here, we're a paradise for all the maggots who can't get away with crap like this in their own states.
Need proof ? How about Triple TTT, Clean Power and now this lawbreaker.In fact who brought in General Dollar and wants to destroy an historical building? You can bet it won't be the last time either with the people we have controlling the town's image.

Just a few questions. Has anyone with the facts and details listed, contacted the proper State authorities and the media? What is our recourse as citizens of Winchester when laws and ordinances on the books are not being enforced? I think a BIG show of concerned citizens at the next BOS meeting might be in order. I do think the lack of work being done, enforcement being applied, and general disregard of our taxpayers should interest a majority of people. Additionally, has anyone considered organizing a picket of the plant....I think September 24th Saturday would be a good day....since alot of people will be out and about for our "Pickle Festival". What a wonderful message we can send to people coming to visit our fine town for the day!

For those of you who don't give a damn let me explain why this is an issue. Three years ago Kathy and Earl Beaman stopped this person from doing this venture on Burt Hill Road. This venture would affect her sisters and them. So here we are with Maggie and Dean as representatives on the planning board.Yep, yes we are going to do whatever he wants-never you mind that people live in that area. So, my take is we need to take the "Beamans" to court for breach of conduct and then maybe someone will listen to what is being said about Mr. Mitchell. Then too we need to ask Mr. Mitchell's town of residence why they will not let him work there. Perhaps it is because he doesn't pay his bills.

Dont count on getting any help from Town Hall. They are thrilled to have Mitchell here. He has been supplying sand at Bob's, paving around town and crushed rocks here and there. So, you have your heads up your "you know what" if you think anyone is going to listen!

Sand & Gravel and crushed stone is not the issue.The fact that the Town is in collusion with Mitchell either receiving as a gratuity or purchasing asphalt from him before his compliance hearings is the issue. He is only given permission from the State to get his plant up to speed; not sell asphalt and the town has given him no permission to do it either as his hearing is not scheduled until next Monday night. More shenanigans from our selectman which will eventually come back to bite them in the ass. But they don't care, it's our money that they'll use to defend themselves when this all goes to court.

Last night after reading this topic I went to the town's site to review the minutes and found that not one meeting is posted on the website, no information on the dozens of meetings held before the zba or planning board, all information on the asphalt plant has been removed. What's up with that? Who's responsible for taking this public information from view? If all of this was on the up and up and above board why hide information from the public?
After reading through my notes, the copies of minutes I got from the town and listening to the tape recordings I made, I found no references anywhere, no written confirmation or even a discussion on Mitchell being allowed to pave the road to the plant, so what's this reference to an agreement with the town stuff, who agreed to allow him to do this? It surely wasn't brought up or is it in the conditions they set for him, he's to "water" the road to keep the dust down, not pave it. Is this one of the reasons public minutes are being hidden, to cover the actions of all this backroom dealing in regards to this plant?

Do the people we have in office ever do anything without controversy or resulting in a lawsuit? What is it with these select few who continue to keep costing the town thousands upon thousands of tax dollars with the decisions they make. If it were something occasional you could chalk it up to a simple difference of opinion and a disgruntled person; but time after time, over and over every month it seems one board or another is being sued. There has got to be something else going on behind the scenes to have this many suits filed by so many different townspeople regarding the same few board members and selectmen that needs to be investigated by an outside authority. The fact that Leroy won't act is a sure sign someone is pulling his strings to protect this Mitchell fella and that isn't right.

Why is it every time we turn around our planning board or zba or board of selectmen are going to court? We need to ensure we have the best qualified people in these positions that follow all of the regulations so there is no more controversy. We need to be sure we elect responsible dedicated honest citizens with no ties to the people who think they run this town and are better than the rest of us. We need to make all positions an elected one and stop this appointing of friends and the same old people over and over on multiple boards. We need for everyone to get their collective heads in gear and get out and vote and we need a total community effort to affect changes for the better of all of us, not just the so-called privileged few. Mark my words, if these few troublemakers were to be voted out and changes implemented there'd be less money spent on legal fees, court cases and other crap and more money available for the real things we need to be a viable town.

After reading all of these comments I decided to see for myself what the fuss is all about and stopped on the way to Keene today to see if I could see any smoke or hear any noises that would justify all this whining. I was so shocked to clearly see all that heavy white smoke coming from just below the tree line and hear all that noisy rumbling and beeping and watch those trucks slam tailgates over and over in just the few minutes I sat at the top of the driveway. I wouldn't put up with that for 10 minutes never mind all day long all week long. Thats a real problem those folks are having with that plant and pit. It looks more like a mining operation than a sand pit and that asphalt plant though hidden from site is spewing tons of stuff into the air and you can smell it up on the road. No wonder that there are so many angry and upset people out that way. You just gotta go see it for yourselves and then you'll know why.

Bumped into Leroy Austin and he confirmed this plant is running and it shouldn't be. Says they have a lot of problems down there and that he's received a ton of complaints but there is nothing he can do because the town's attorney won't let him act? When I asked what he meant he wouldn't say. He also told me the selectmen won't listen to him or anyone else about this asphalt plant even though the state has yet to inspect them prior to operation. He's well aware of the noise and other problems and said he has many concerns but he said his hands were tied. This makes me wonder what's really going on here and I feel for all of those people in the Westport Village and Combs Bridge area something is going on that isn't right.

Leroy does what he is told. He will tell you anything to placate you but in the end he's too worried about his cushy job and doesn't do anything that would cause him to lose it. For years I have warned the town’s people if you didn’t nip this corruption in the A$$ it will only grow. I have (with some help from some supporters) spent a lot time and money trying to bring the corruption in this town to your attention with my news letters. Yes! We got rid of part of the corruption with John Stetser leaving., but I said at the time it is only a start. What I received in return was to be called names. Mike Towne spent many hours and money he didn’t have to stop a condo project that would have cost all of us in higher taxes. What Mike received was the same name calling.

It is time you the people come out from behind anonymous and get organized against the corruption in this town. Surly there is someone out their to get people organized or talk is cheap. What are you people afraid of, they will raise your taxes. That is going to happen any way.

Can we say Zombieland ? That's what 95% of the people are in this town. There are only a handful of brave and honest folks who step up and come forward only to be ridiculed or worse for their efforts to improve the lives of all of us. The powers that be that have had a stranglehold on this town for 15 years or more aren't happy with them or this blog and the fact that those who started and continue to put up information for all of us that we otherwise would not hear anything about are to be royally thanked and commended for their efforts and fortitude. Bob, you've stuck your neck out for all of us many times, this other fellow you mention I don't know other that some calling him a big mouth and the reason thousands of our tax dollars got spent defending the town against his lawsuits. It takes a strong hearted man to stand up for what he believes is right and your willingness and that of this Towne fella to wage war against the Town on behalf of all us is something to be proud of. We need more people willing to fight for whats right otherwise we'll continue to live in Zombieland and be ruled like the sheep most have become.

To the person who thinks the Informer should move and that Winchester was doing so great as a town prior to this blog, I can only surmise that you are either one very misinformed simple minded person or you're on some kind of drug like prosaic or another mind altering medication that has really skewed your way of thinking. #1, you don't speak for all of us. In fact you don't even speak for a majority of the people in town. Your opinions are those of yourself and no one else. #2, who gave you the right to decide who lives here and who should move, who died and left you in charge? I know of no decree or law that stipulates who can reside where and who can't. Perhaps it is you who should think about a change of venue if you're so upset by the actions of those that seek the truth and expose the lies that come out of town hall on a daily basis. Although there are allot of wrong doings that go on in town its things you don't post about Like the BS Gordon pulled using her position on the planning board and BTW why haven't you let your readers know that her law suite was thrown out of court or dismissed seems like you couldn't wait to post that she filed one but not a word from you about it not going anywhere! Another wrong doing is Bob Davis being appointed to the Budget committee we the voters voted him off the Budget committee and said no thank you to his select board bid but he ends up back on the budget committee anyway, Tell us that's not a slap in the face for the people who do go and vote.
So maybe these are some of the wrong doings we would like to see you discuss

About the bloger who feels the need to belittle, or dismiss or demonize the importance the Winchester Informer’s serves the community. Before the Informer came along we had no knowledge of what our trusted elected officials where pulling behind our backs. How many knew about a condo project that would have destroy a tranquil mountain side. A known questionable developer who’s projects that would have devastated the land, and placed a liability on the tax payer while over whelm the already broken school system.

Years past the selectmen, planning board and the waste water commission had complete control over who was allowed to connect to the town’s sewage system or town's water supply and who was allowed subdivide. These town bodies had total control over everyone’s life without most knowing. In the past days of Bucky Jones, Leroy Austin and other town elects making special deals are now open discussion here on the Informer. The names of the elected officials have changed but their action are still the same.

I feel the people who want the Informer gone have something to loose or supporting the few people that make the rules for the majority. The objectionable people to the Informer are either afraid of the fact or nervous someone will inform us (the concerned) of their dirty little tricks going on behind selectmen’s closed doors.

This is why it is the up most importance to vote.

You keep talking about shedding light about wrong doings but at the end of the day its nothing but hostile rumors and lies. Why do you think every bogus law suite you or your followers file is thrown out or dismissed, We have asked several times for you to list any law suits the Town has lost and to date you haven't. Winchester has a bad reputation to overcome and the BS that is spread around on this site only make it worse.
You really want to impress us then start using names and post documents to back up your statements and then if there is really any wrong doings we will see it but right now everything we read here is "word on the street" and "I heard so and so say"
The sad truth is there may be six of you who didn't get your way about something so now you want to drag the whole town into your rants and make our reputation Even worse than it is. Good Job you should be so proud of yourselves.
Thank god the voters see right through you and do the right thing every March and will continue to do so.
So we challenge you show us the law suites you have won post some documents from credible people use your name when your talking about "word on the street" and then we will see if there is any truth to the comments we hear on this site

WTF is this crap about lawsuits from you all the time? I don't know why the Informers allow you to even post. The fact that the town has been sued dozens of times because of the decisions certain boards are making and may I remind you that the same people are on these boards making these bad decisions is enough to show all of us just what the real problems in this town beside voted apathy.
As for a law suit recently won by citizens, Towne and Homan v. town of Winchester planning board. If you read the judge's decision they won and Sharra was cited by the judge for having illegal communications with Van Dyke and others trying to stack the deck against those guys. Again, they won and the board had to hear their appeals. So fool go check your facts. Sharra cost this town thousands. How's that for facts.
So stuff that in your big mouth and take a hike.

The town has lost several lawsuits, ask Butch, The town has been taken to court over taxes, improper water and sewer bills and a host of other reasons over the years and yes, the courts have found in favor of the people filing those suits. What you fail to realize is that every time the town is sued, the town attorney is involved and he charges a fee for his services, the town loses. What people are becoming aware of and what this blog has been reporting is the escalating number of times certain boards are being sued and why. There is really something very wrong with the way certain things are being done in this town, how they affect many people and who is benefiting from these decisions. The fact that people are not rolling over and taking the crap they did for years is a good sign that some in this town are willing to fight for all of those who sit home and do nothing.
Go check your facts before you spout nonsense.

No one wins when the town gets sued, both sides spend money that could be well spent for other endeavors.
Yes, I was part of a lawsuit filed against the Planning Board in the past for procedural errors they committed and because the Chairman acted outside of her authority and committed unlawful acts. The result of her actions and influence, was an unfair and unlawful decision by the board. There were 9 people involved in that lawsuit, my name was first because I was an abutter. To file an appeal, whether it be before the Planning Board, ZBA or in a court of law, someone must have standing according to the law; thus my name was used for the filing before the ZBA and in Superior Court when the ZBA blew us off and would not hear our appeal to them.
Don't blame people for doing what they have to in order to have fairness before these boards, it's some of the people on these boards that are causing these lawsuits. In our case, Judge Tucker ruled in our favor that Margaret Sharra had broken the law and ordered a re-hearing based on facts he found were truthful in our testimony. Had the ZBA acted responsibly and actually listened to the testimony given and paid attention to the evidence presented instead of trying to protect a friend and quasi-member of the board, no court case would have been filed.
That several people in this town are members of several boards and/or committees and use these positions to influence decisions is shameful and unethical. No one person should wear so many hats in this town, that they can control outcomes of any decisions made by using their friendships and influence. There are many who would serve and do well; but our Selectmen have put in place a system in which they control, through the people they appoint or support at election time, all outcomes to suit their own agendas and uphold the status quo.
To those of you concerned about lawsuits, wasted money and unfair decisions from these boards, I say change starts at the top. Vote out those who would control this town like it's there own personal money trough. Go to the polls and elect people who will follow the will of the people and ensure that rules and regulations are enforced as they should be for everyone, no matter who you are.
The town of Winchester and it's people should come first in all decisions made by all boards and committees and money should only be spent to defend those decisions against threats to the health and welfare and safety of all; not personal gain.
Until this happens there will be many more lawsuits, wasted dollars and division in Winchester, the choice is in your hands to stop this cycle.

Thank you Mr. Towne for that information and for sharing your thoughts. That's quite a bit different from the rumors and character bashing that I got from certain people downtown and stories circulating at church. I have to admit I was a part of your character assassination; but after reading your posting above am convinced you have been wronged by many who are quick to judge people we don't even know, my apologies to you and I agree completely with you that no one wins when lawsuits are filed and that there have too many of late.

After reading through all of this I wonder exactly what the board of selectman's role in all of this is? Why haven't they called a special meeting to discuss all these complaints from townspeople and investigated? As the ruling body in town their sole role is to make sure everything affecting the town is on the up and up. Are they ignoring this situation because they are in bed with this Mitchell guy or are they just hoping this will all go away? Something stinks and it sure isn't just the smell of asphalt.
