Mitchell's Attorney Sends Out Threatening Letters

We have received several reports that Massachusetts Attorney Kevin Parsons has sent out letters to a number of Winchester and Swanzey residents who have filed complaints with the Town of Winchester and the Department of Environmental Services, informing them that they have been singled out and threatened with arrest if they set foot on Mitchell's property. The letters were forwarded to both the Winchester and Swanzey Police Departments, making it look as though these people had done something wrong, had committed some illegal act or are a threat to Mr. Mitchell. None which is true. Their only offense was to take pictures and file complaints of illegal activity and to gather evidence of violations in a peaceful manner.  There was no evidence provided and residents also stated they had not set foot on his property at all while taking pictures as the Town's Code Enforcement Officer and State Compliance Board had requested when filing complaint to them.

Our guess Mitchell got upset at all of this exposure and this is his way of showing what a good neighbor he's claims to be. It's a real shame that no one informed him that actions speak louder than words.

What are you trying to hide Mr. Mitchell?

Our own Town Code Enforcement Officer got one for god-sakes, what the hell is going on? These things can't be legal coming from an attorney not even licensed to practice in NH

I guess the lesson here is do not file a complaint with the town. Your name and address will be released and you will be harrassed. Didn't someone question why we post here ANONYMOSLY? Well, here's your answer. To be honest, I think the town is sooooo supportive of the asphalt plant because it IS in Mr. Towne's "neighborhood". Just another way to make him miserable. Very disheartening.

Parsons isn't allowed to practice law in NH so those letters aren't worth the paper they are printed on and I know Mike Towne and pissing him off is not something those people want to do. He's a bulldog and won't let this rest until justice has been done. Just look how hard he fought for himself and his neighbors over the Van Dyke fiasco and he was right all along. I can see him fighting just as hard over this matter. If they foolishly think he'll give up or allow them to crap on him or his neighbors they will learn it's best to let sleeping "old" dogs lie.

Yes, Mike Towne is tenacious and highly protective of his neighborhood, but he does not stand alone. Far from it. The neighborhood group and other citizens of Winchester and Swanzey known as the Ashuelot River Anti-Asphalt Campaign stand behind Mike and his work to block Mitchell Sand & Gravel from the path of destruction they would otherwise relentlessly bestow on this area. We are all tenacious! We have no intentions of backing off. I am personally proud of my letter from Mitchell's attorney. It just means we are succeeding. And the last commenter is correct. Those threatening letters are not enforceable and not worth the paper they are written on. If anyone wants to join this group and actually take some action about the issue, contact Mike. We are having a group meeting friday night 9/30 and we would love your attendance and support! I am not afraid to sign my name here.

ROFLOL OK. A lawyer letter from a lawyer must mean guilty of doing something wrong? LOL. Must have deserved it? Like as in a threat or punishment? When you don’t even know who or why? LOL. Ignorance and gullibility are why the Informer is needed. Too many just blindly take the word of liars, crooks and thieves as gospel without evening looking to see if there is any substance or truth behind what they say. LOL. Go Informer Go.

Oh, please poster at 5:01 on the 29th.These people got letters because they had the courage to tell Mr. Mitchell that he was not wanted in that area. Oh course, the Beaman's and Ms. Sharra did not get one. If I lived in that part of town I would be asking what high jinks and promises were made by these people to get Mitchell to move his plant from Burt Hill and Route 10 to this area of Route 10. Once again it seems as though the Beaman faction is behind this. Perhaps when the Beaman's move we can have our town back or it may be sold to the highest bidder.It will be Clean Energy's turn.

Let's see what did I do wrong?

I attended ZBA and Planning Board meetings and voiced my concerns in regards to the health and environmental issues having this plant in such close proximity to so many homes and the Ashuelot River, which feeds our town wells and those wells of the people living along the river.

I filed complaints with the Town Code Enforcement Officer and the Board of Selectman when Mitchell violated town regulations and the conditions set by the Planning Board when they issued him a conditional approval. Then I backed up my complaints with pictures clearly showing and proving my claims.

I filed a written complaint to the Department of Environmental Services when I observed Mitchell violating state laws and regulations and also sent them pictures to back up my claims.
I have not committed and criminal acts towards Mitchell.I have never set foot on Mitchell's property, never issued any threats of violence to him or any of his employees and have never vandalized any of his equipment or buildings.

The only "criminal" thing I can think of that I may have committed to give Mitchell and his attorney any reason to send me a threatening letter and put my name on a list of people to be aware of at the Swanzey and Winchester Police Depts. is, that I objected and still do, to having this old, decrepit, smelly, polluting plant and ultra noisy, dust spewing, quarry operation creating a health hazard and nuisance in my neighborhood. We all know the reasons why this operation was a go from the start and who's behind it.

When your Town Code Enforcement Officer is told to shut up or find another place of employment ( his words to me ) the BOS refuses to discuss the problems with Mitchell's constant and ongoing violations and the Planning Board acts illegally with no regards for the legal consequences of their actions, you're left with no choice but to seek relief through the courts.

Yup, I most assuredly deserved to get a letter and like Mrs. Ryan above, I am proud to have been included in such good company. It may surprise you to know who else got these letters.

Oh, come on Mike spill the beans. We want to know who the top "40" are. Pardon my humor but this little venture had to cost the idiot at least $2,500. The man cannot pay his bills but he can send threatening letters. So, tell me what's wrong with this?

I can also attest to the fact that Leroy Austin our code enforcement officer received a threatening no trespass notice from Mitchell's attorney Rob Parsons as he told me himself and then called the Town's attorney Barton Mayer to get it lifted so he could attempt to do his job.
You owe this blog an apology John P. you obviously have been told something that wasn't true.

He did not get a letter. I cant prove a negative. So Mike, why dont you get a copy of the letter and post it on the WI. If he did get one, it is a public record and Leroy would be obligated to give it to you. Since you have regular contact with Leroy you should be able to get it. Otherwise I stand by my statement you are not telling the truth... which is a common theme here

Gee Whiz Big surprise The WI has been asked to prove one of its statements and refuses to do so.
And the colorful language from Mr.Town is the same way he has spoken at public meetings in the past. No wonder why the voters will never make him a selectman or planning board member, Very unprofessional.
Very easy to see that the WI supporters are starting to understand the are seriously outnumbered and will never win their battle seems like some people are coming unglued.

To the commenter above, Leroy did receive a notification. Your attempt to discredit Mr. Towne is baseless. To the other jerk complaining about Mr. Towne's colorful language, since when is calling someone an a$$kisser so outrageous, I have seen worse language printed in newspapers and spoken on TV, get real. He simply has the guts to call it like it is, we all know Mr. Pasquarelli will say and do anything to promote himself and have seen him in action numerous times making a fool of himself at town meetings. It is obvious how you feel about this man, and are so ashamed of your words you don't dare post your name as he does. You are a coward to hide and make statements about someone else. He has and always will have my vote for his honesty and straightforwardness and if he does decide to run again I hope the people of Winchester wise up and give him a chance to prove his worth to the town.

I challenge you to provide evidence that the comments I have posted on this blog are false, untrue in any manner or as you say a crock. I also challenge you to come forward and provide me with your name as I do when I post so that I may address you personally as you do me. You laugh about others for using the anon feature provided and point fingers at those who provide this blog as a sounding board for all of us and yet you too hide, calling the kettle black as the saying goes. These are the actions of a coward, too ashamed of their conduct to put a name to the spiteful comments they make.
